Welcome to Cuti-E. These Terms of Service ("Terms") govern your use of our character-driven feedback platform and services. By using Cuti-E, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Cuti-E ("Service"), you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not use the Service.

2. Description of Service

Cuti-E provides:

• A feedback collection platform for mobile applications
• iOS and Android SDKs for app integration
• Admin dashboard and mobile apps for managing feedback
• Character-driven conversation interfaces

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information as needed.

4. Subscription Plans and Payment

4.1 Plans

Cuti-E offers multiple subscription tiers (Free, Starter, Pro, Business) with varying features and limits as described on our pricing page.

4.2 Billing

• Paid subscriptions are billed monthly in advance
• Prices are in USD unless otherwise specified
• We may change prices with 30 days' notice

4.3 Refunds

We offer a 14-day money-back guarantee for first-time subscribers to paid plans. After this period, subscriptions are non-refundable.

4.4 Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Transmit spam, malware, or malicious content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Collect user data without proper consent
• Reverse engineer or decompile our software
• Use the Service to harass, abuse, or harm others
• Violate any applicable laws or regulations

6. Your Content

6.1 Ownership

You retain ownership of all content you submit to the Service, including feedback messages, images, and configuration data.

6.2 License Grant

By submitting content, you grant us a limited license to store, display, and process your content solely for providing the Service.

6.3 Content Responsibility

You are solely responsible for the content you and your users submit. We do not monitor or pre-screen content but may remove content that violates these Terms.

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, code, and documentation, is owned by Invotek AS and protected by intellectual property laws.

7.2 Feedback About Cuti-E

If you provide suggestions or feedback about our Service, we may use it without obligation to you.

8. Third-Party Services

The Service may integrate with third-party services (e.g., Apple Push Notifications). Your use of such services is subject to their respective terms.

9. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws including GDPR.

9.1 Data Processing Agreement

For Business tier customers processing EU personal data, we provide a Data Processing Agreement (DPA) upon request.

10. Service Availability

10.1 Uptime

We strive for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance when possible.

10.2 Modifications

We may modify, suspend, or discontinue any part of the Service with reasonable notice. For paid features, we will provide at least 30 days' notice.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for any loss of data, profits, or business opportunities

13. Indemnification

You agree to indemnify and hold harmless Cuti-E and Invotek AS from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content submitted by you or your users

14. Termination

14.1 By You

You may terminate your account at any time through the account settings or by contacting us.

14.2 By Us

We may suspend or terminate your account if you violate these Terms, with or without notice depending on severity.

14.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your data after a 30-day grace period
• Provisions that should survive termination will remain in effect

15. Governing Law

These Terms are governed by the laws of Norway. Any disputes shall be resolved in the courts of Oslo, Norway.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by:

• Posting the new Terms on this page
• Sending an email notification (for material changes)
• Displaying a notice in the Service

Continued use of the Service after changes constitutes acceptance of the new Terms.

17. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Cuti-E.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not waive that right.
• Assignment: You may not assign your rights under these Terms without our consent.
